REGULATIONS OF THE ONLINE STORE PLANECENTER.COM

§1 General Provisions

  1. The online store Plane Center, available at the website www.planecenter.pl, is operated by Wojciech Żakiewicz conducting business under the name Wojciech Żakiewicz in Katowice 40-026, ul. Wojewódzka 27/5a, Tax Identification Number (NIP): 6342832149, National Business Registry Number (REGON): 360020392.

  2. Whenever the following terms are used in this regulation, they shall be understood as follows:

    Online store - the store operated by Wojciech Żakiewicz, conducting business under the name Wojciech Żakiewicz in Katowice 40-026, ul. Wojewódzka 27/5a, NIP: 6342832149, at the website www.planecenter.pl
    Seller - Wojciech Żakiewicz, conducting business under the name Wojciech Żakiewicz in Katowice 40-026, ul. Wojewódzka 27/5a, NIP: 6342832149
    Customer - a natural person, legal person, or organizational unit without legal personality but having legal capacity, using the Online Store, especially one who places an order through the Online Store according to the rules specified in this Regulation.
    Order - the Customer's declaration of will specifying the type and quantity of goods available in the assortment of the Online Store at the time of placing the order, the method of payment, the method of delivery of the goods, the place of delivery, and the Customer's data, submitted using the Order Form, aiming directly at concluding a Sales Agreement of a Product or Products with the Seller.
    Order processing time - the number of working days in which the Seller will complete the order placed by the Customer in the Online Store, entrust the ordered goods to the carrier, and deliver the ordered goods to the location indicated by the Customer in the order.
    Working days - weekdays from Monday to Friday, excluding public holidays.
    Order Form - an interactive form available in the Store allowing the submission of the Order, in particular, by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
    Cart - the functionality of the Online Store allowing the display of selected products for purchase and the entry and modification of order data, such as the number of products, delivery address, invoice data, delivery method, and payment methods.
    Customer Account - a Customer account allowing the use of the Online Store.
    Product - a movable item available in the Store, subject to a Sales Agreement between the Customer and the Seller.
    Warehouse - the warehouse located at Panewnicka 343a, where Customer orders are processed.
    Civil Code - The Civil Code Act of April 23, 1964 (Journal of Laws 2018.1025 consolidated text of May 29, 2018, as amended).
    GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

  3. This regulation defines the rules for using the Online Store, in particular the rules for concluding sales agreements for goods available in the Online Store, the rules for performing these agreements, and the rules for the complaint procedure.

  4. To browse the websites of the Online Store, including viewing the Store's assortment and placing orders, the following is necessary:
    • having an end device (computer or other multimedia device) with access to the Internet;
    • having an Internet browser such as Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari in the current version;
    • having an active login and password - assigned to the Customer by the Seller.

  5. The Customer using the Online Store is obliged to use it in accordance with the applicable law, the provisions of this Regulation, and with respect for the good customs and personal rights of other entities. It is prohibited for the Customer to provide unlawful content and to act by sending or placing unsolicited commercial information (spam) within the framework of the Online Store, conducting any commercial, advertising, or promotional activities on the Online Store's websites.

  6. Browsing the Store's assortment requires registration. Customer orders for products in the Store's assortment can be placed after registering.

§2. Registration and login

  1. The Seller provides electronically services enabling Customers to create and use a Customer Account on the website of the Online Store at www.planecenter.com.

  2. The Customer Account allows the use of Online Store functionalities after logging in, including:
    • entering, editing, or deleting data, including delivery addresses;
    • placing orders using data entered by the Customer;
    • creating, storing, or deleting lists of saved products;
    • accessing the order history; accessing the status of the order;
    • changing the login and password for the Customer Account.
  3. The Customer Account is not transferable.

  4. In order to create a Customer Account, the Customer should complete the registration form. It is necessary to provide the following data: name, email address, contact phone number, and password.
  5. During registration, the Customer accepts these regulations and agrees to the processing of their personal data for the purposes necessary to provide electronic services by the Seller.

  6. The customer is responsible for the accuracy and correctness of the data provided during registration. The customer can view and correct their data at any time by logging into the store's website.

  7. The Seller may deprive the Customer of the right to use the Customer Account and may limit their access to part or all of the Online Store's resources if the Customer violates the law, the provisions of these Regulations, or the rights of third parties, or when it is justified by security reasons - in particular, hacking attempts or other actions that could disrupt the functioning of the Online Store. The Seller takes into account the gravity of the violation and its recurrence in the decision to deprive the Customer of the right to use the Customer Account.

  8. The Customer may, at any time and without giving a reason, delete the Customer Account, which entails the removal of all data concerning the Customer.

§3. Product information

  1. The Online Store provides information about Products that are available for purchase, in particular, their main characteristics, prices, and terms of the sales agreement. The information provided on the website of the Online Store does not constitute an offer as defined by the provisions of the Civil Code but an invitation to conclude a sales agreement.

  2. The product prices in the Online Store are given in Polish zlotys (PLN) and are gross prices (including VAT).

  3. The price given for each Product is binding at the time the Customer places the Order. The price does not change regardless of price changes in the Store, which may occur in relation to individual Products after the Customer places the Order.

  4. The availability of Products in the Online Store may vary. The Customer will be informed about the unavailability of the Product ordered.

  5. If the Customer chooses the method of delivery other than the personal collection, the cost of delivery will be indicated at the time of placing the Order. The customer will be informed about the total price, including the cost of delivery, before placing the Order.

  6. The Seller reserves the right to change the prices of Products, to introduce new Products to the Store's assortment, to conduct and cancel promotional campaigns on the Store's websites, or to make changes to them, according to the procedures described in these Regulations.

§4. Placing orders

  1. The Customer can place orders in the Online Store 24 hours a day, 7 days a week.

  2. To place an order, the Customer should log into the Online Store (if they have a Customer Account) or complete the order form without registration.

  3. The Customer places an order by adding Products to the Cart.

  4. When placing an order, the Customer provides the following data: name, delivery address (street, house/flat number, postal code, city, country), email address, and contact phone number.

  5. The customer can modify the order data, including the chosen Product, method of delivery, and payment method until they click the "Place order" button.

  6. By clicking the "Place order" button, the Customer submits a declaration of will, leading to the conclusion of a sales agreement with the Seller, based on the conditions specified in the product description.

  7. After placing an order, the Customer receives an email confirming the order's receipt and listing its details. The email contains all essential information about the order, as required by the provisions of the Act on the provision of electronic services.

§5. Order processing

  1. The Seller will process the order within the time specified in the Product description. The order processing time does not include the delivery time.

  2. In the case of ordering Products with different order processing times, the longest specified time will be applicable to the entire order.

  3. If the Customer orders Products with different delivery times, they have the option to request split deliveries or to deliver all Products after completing the entire order. In the case of a split delivery, the Customer incurs additional delivery costs, equivalent to the cost of delivering the order in parts.

  4. If it is impossible to determine the Customer's will regarding the order's fulfillment (e.g., due to unavailability of the ordered Product), the Seller will contact the Customer using the provided contact details to clarify the order's scope.

§6. Payment methods

  1. The Online Store provides the following payment methods:
    • Payment on delivery upon receipt of the ordered Product;
    • Payment via electronic transfer to the Seller's bank account;
    • Online payments via PayPal.

  2. The Customer is obliged to make the payment within the period selected during the ordering process, counting from the date of the contract's conclusion. If the Customer fails to make the payment within the set period, the order will be canceled.

  3. In the case of payment by bank transfer or electronic payment, the Customer is obliged to make the payment within 7 days from the date of the contract's conclusion - otherwise, the order will be canceled.

§7. Complaint handling

  1. The basis and scope of the Seller's liability towards the Customer who is a consumer within the meaning of art. 22[1] of the Civil Code for non-compliance of the Product with the Sales Agreement are defined by generally applicable laws, in particular, by the Civil Code (in particular, art. 556-576 of the Civil Code).

  2. Complaints related to the provision of electronic services by the Seller and other complaints related to the functioning of the Online Store (excluding Product complaints) may be submitted by the Customer, for example:

  3. In the complaint, the Customer should include their name, contact details, and a description of the complaint's subject.

  4. The Seller will respond to the complaint immediately, no later than within 14 days from the date of its submission.

  5. The Seller informs that the complaint procedure is voluntary and has access to extrajudicial means of handling complaints and redress. Detailed information about the possibility of the Customer, who is a consumer within the meaning of art. 22[1] of the Civil Code, using extrajudicial means of handling complaints and redress, as well as the rules of access to these procedures, is available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodeship Inspectorates of the Trade Inspection, and the following Internet addresses of the Office of Competition and Consumer Protection: https://www.uokik.gov.pl/spory_konsumenckie.php, http://www.uokik.gov.pl/sprawy_indywidualne.php, and http://www.uokik.gov.pl/wazne_adresy.php.

§8. Withdrawal from the contract

  1. The customer who is a consumer within the meaning of art. 22[1] of the Civil Code, has the right to withdraw from the Sales Agreement without giving a reason within 14 days from the date of delivery of the Product.

  2. The Customer may withdraw from the Sales Agreement by submitting to the Seller a statement of withdrawal from the contract. To meet the deadline for withdrawal, it is sufficient to send the statement before its expiry.

  3. The statement of withdrawal from the Sales Agreement may be submitted:

  4. The Seller will promptly confirm to the Customer the receipt of the statement of withdrawal from the Sales Agreement.

  5. In the event of withdrawal from the Sales Agreement, the Agreement is considered void, and the Customer is released from any obligations. The returned Products should be delivered to the Seller's address within 14 days from the date on which the Customer withdrew from the Sales Agreement.

  6. The Seller is obliged to immediately, but no later than within 14 days from the date of receipt of the Customer's statement of withdrawal from the Sales Agreement, return to the Customer all payments made by them, including the cost of delivering the Product (except for additional costs resulting from the Customer's chosen method of delivery other than the cheapest standard delivery offered by the Seller).

  7. The Seller will refund the payment using the same method of payment as used by the Customer, unless the Customer has expressly agreed to a different method of refund that does not involve any costs for them.
  8. The Seller may withhold the refund until the Product is received or until the Customer provides proof of its return, depending on which event occurs first.
  9. The Customer should return the Product to the Seller's address specified in this Regulation immediately, but no later than within 14 days from the date on which they withdrew from the Sales Agreement. The deadline is met if the Customer sends back the Product before the 14-day period expires.

  10. The Customer bears the direct cost of returning the Product.

  11. The Customer is responsible for reducing the Product's value resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

§9. Final provisions

  1. The Seller reserves the right to amend these Regulations for important reasons, i.e., changes in the law, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer about any changes to the Regulations by publishing the text of the amended Regulations on the website of the Online Store, along with information about the fact of making changes.

  2. In matters not covered by these Regulations, generally applicable laws shall apply, in particular, the Civil Code, the Act on the provision of electronic services, the Act on consumer rights, and the GDPR.

  3. Any disputes arising between the Seller and the Customer who is a consumer within the meaning of art. 22[1] of the Civil Code will be resolved before the competent common court in accordance with the relevant provisions of the Code of Civil Procedure.

  4. Any disputes arising between the Seller and the Customer who is not a consumer within the meaning of art. 22[1] of the Civil Code will be resolved before the court with jurisdiction over the Seller's registered office.

  5. These Regulations come into force on 25.07.2023
